Court Proceedings - Accelerated
procedure (Possession only - s21)
With a signed Tenancy Agreement and a valid s21 Notice the accelerated
procedure will be used (deposit protected? - please call us to discuss the importance of protecting the deposit
in one of the Government protection schemes). We will prepare and serve the Court Papers together with any
further relevant documentation to the County Court. This procedure offers the Landlord the return of their property
in as short a time as practicably possible. Usually there is no court attendance (unless defended - rare) and so long
as the paperwork is prepared correctly then the court will make an order for the Tenant to leave the property.
Court Proceedings - (Possession of property and rent arrears - s8 & s21)
This
procedure is used usually with a s8 Notice and is also a money claim (rent arrears). We will prepare and serve
the Court Papers together with any further relevant documentation to the County Court. The Court will set a
hearing date, usually between four to eight weeks. With the correct preparation of the paperwork and the accompanying
evidence/documentation there will be no need for a lawyer to attend as you the Landlord will be fully prepared, by us, to
present your case with confidence. This is usually a five minute hearing and you walk away with a Court Order and a
County Court Judgment in your favour for the rent arrears.
